Ct., Sanford standing in the roadway in front of the school bus. Brandt told Deputies he was upset w/ the bus driver because she had told him to sit down. Brandt told Deputies he was not moving from the roadway and was not going to allow the bus to continue on its way. Brandt refused Deputies commands and was arrested for disorderly conduct. Brandt was held under $500 for disorderly conduct.

Deputy Uses Deadly Force at Dreamland MHP

On December 8, 2009 at approximately 10:15 PM, a Lee County Deputy wounded a man identified as Gilmer Escobar (31) W/M of Lot 61 Dreamland MHP Sanford. Deputies responded to Lot 61 Dreamland MHP Sanford after Escobar called 911 and reported he was going to commit suicide. Upon Deputies arrival they encountered Escobar w/ a knife and what was believed to be a pistol. Escobar's actions caused the deputy to respond w/ deadly force, thus discharging his firearm and striking Escobar in the right arm. Escobar was treated at Central Carolina Hospital for superficial wounds and released.

Escobar has been sent for a mental evaluation, a family member reported Escobar has a long history of mental illness.

The SBI is investigating the officer involved shooting as standard procedure.

An undercover operation by the Lee County Sheriff’s Office Narcotics Division has resulted in the seizure of 917 grams of Cocaine and the arrest of one person. Carlos Manuel Ortiz, 20, of 2622 Brick Capital Court, Sanford, NC, was arrested after agents seized the drugs during an undercover operation in the West Sanford area of Lee County. Ortiz was placed in the Lee County Jail under $400,000.00 secured bond. The seized drugs had an estimated potential street value of $183,400.00.

at 223 B Carthage Street. During the ceremony, the Sheriff's own nephew, Dillon Gattis received his brown belt. Owner Sensei Ben Brooks and Instructor Kevin Julich were present to hand out belts to all that graduated colors.

During the ceremony, Sheriff Carter was awarded an honorary black belt by Sensei Ben Brooks.

Meth Lab Discovered

On 11-24-2009 agents of the Lee County Sheriff’s Office executed a search warrant at 461 Barringer Road, Sanford, and arrested two persons after finding Methamphetamine and the components of a Methamphetamine production Lab. Agents of the State Bureau of investigation assisted in the investigation, dismantled the components a removed all hazardous materials and evidence.

Lee County agents charged Robert Mike Thomas Jr., 39, of the residence and Brooke Pamela Stevison, 32, of 708 Fairground Road, Dunn, with Manufacturing Methamphetamine, possession of Methamphetamine, possession of precursor chemicals, maintaining a dwelling to keep/store drugs and possession of drug paraphernalia. Both were placed in the Lee County Jail under $300,000.00 secured Bond.

The investigation is on going and additional arrests are possible. The Sheriff’s Office and SBI were also assisted by the Lee County Fire Marshall’s Office and members of the Deep River Fire Department.

“The holiday season is right around the corner and shoppers are crowding malls and discount stores to buy the latest gadgets and find the best deals,” said Sheriff Carter of Lee County.

But what shoppers are neglecting is their safety. According to Sheriff Carter “This time of year attracts more shopping-related criminal activity because of the larger crowds and the extended store hours. These factors and the usual distraction of shopping, creates a more favorable environment for petty thieves and other offenders.

The Sheriff reminds all Lee County residents to follow these safety tips:

Shopping Safety:

· A single shopper is the best target for theft. Always shop with a friend or relative.
· When going shopping, tell someone where you are going and what time to expect you
to return. Also, make sure they know what you are wearing, as well as the type of vehicle
you are driving.
· Shop during daylight hours. If you shop at night, park your vehicle in a well-lit area.
· Dress casually and comfortably and avoid wearing expensive jewelry. If carrying
cash, keep it in your front pocket rather than in a purse or wallet. This makes it much
more difficult for a pick-pocket to remove. Also store car keys in a pants or jacket pocket.
If your purse is stolen, you will still be able to drive home.
· Pay careful attention to your surroundings and avoid overloading yourself with packages.
It is important to have clear visibility and freedom of motion to avoid mishaps.
· When returning to your vehicle, check around it and in the back seat. Be aware of
strangers approaching you for any reason. Have you car keys in your hand to avoid
spending unnecessary time unprotected from the security of your vehicle.
· If you feel uneasy returning to your vehicle alone, find a security guard and ask them to
walk you to your car.

According to Sheriff Carter “During this time of year, busy holiday shoppers become careless and vulnerable to other crimes as well. Credit card fraud and gift card fraud are on the rise. However, taking a few preventive measures can help.”

Credit Card Fraud:

· Keep a close watch on your credit card every time you use it, and make sure you
get it back as quickly as possible.
· Never write your PIN number on your credit card.
· Never leave your credit cards or receipts lying around.
· Shield your credit card number so that others around you can’t copy it or capture
it on a mobile telephone or other camera.
· Only carry credit cards that you absolutely need.
· Shred anything with your credit card number written on it.
· If you’re planning to purchase online, make sure the web page where you enter your credit
card information is secure through SSL (Secure Socket Layer). You can tell if the web page
is secure by looking for the gold lock or key icon at the bottom corner of your browser
window.
· If you’re not comfortable submitting your information through the internet, call the seller
and give them your information over the telephone. Never send your credit card
information via email.
· Check the company out. Only do business with companies that provide a physical address
and telephone number.
· Keep good records. Always print out a copy of any online products or services you purchase.

Gift Card Fraud:

· Never buy gift cards from online auction sites. This is a large source of gift card fraud.
Many of the gift cards are stolen, counterfeit or used.
· Only buy gift cards directly from the store issuing the gift card or from a secure retailer’s
website.
· Don’t buy gift cards off of publicly displayed racks in retail stores. Only purchase gift cards
at the sales terminal from the cashier.
· Always carefully examine both the front and back of a gift card before you buy it. If you see
a PIN number, ask for a different card. If the card looks like it has been tampered with in
any way, put it back.
· Always ask the store cashier to scan the gift card in front of you. This will guarantee that
your card is valid when you buy it and that it reflects the balance you just charged it with.
· Always keep your receipt as a proof of purchase as long as there is money stored on the gift
card.
· If possible, register your gift card at the store’s website
· Never give your Social Security number, date of birth or any other unneeded private
information when purchasing a gift card. No reputable company will ask for this information.

In light of these problems, Sheriff Carter warns shoppers to be careful so that they don’t become the victim of criminal activity. “Unfortunately, when shopping, people have a tendency to let their guard down,” said Sheriff Carter. “However, paying attention and taking precautions can help eliminate their chances of being victimized.”

Joint Operation Nets 4 Kilos

Chatham County sheriff’s deputies seized four kilograms of cocaine and arrested three during a joint operation with the Lee County Sheriff’s Office and the U.S. Customs Office in Siler City Thursday.Alsibiades Arrizon Santoya, 25, Ontiel Perez Gallegos, 29, and Maria Espinoza Perea, 18, all of 405 Fellowship Church Road, Siler City, were charged Thursday with trafficking in cocaine, manufacturing cocaine, possession with intent to sell and deliver cocaine, maintaining a vehicle for drugs, and possession of drug paraphernalia.Chatham deputies said they found the drugs, as well as $96,000 in cash and three firearms, in the suspects’ home after executing a search warrant there.Deputies also seized two vehicles from the suspects.All three suspects were placed in the Chatham County Jail under $150,000 secured bond.

LILLINGTON — A Lee County sheriff’s deputy who shot and killed her husband in June has been charged by Harnett County authorities with murder. Angie Renee Clark, 40, of 201 Ripley Road, Cameron was charged Tuesday with murder in connection with the June 10 death of her husband Michael. Clark, a Lee County patrol deputy since 2007, told Harnett County authorities that she shot and killed her husband at their Bee Hive Lane home in Broadway. Neighbors at the time suggested the shooting could have stemmed from a domestic dispute between the couple. Clark was charged after a Harnett County Grand Jury handed down an indictment in the case Tuesday. Harnett County authorities, who said Clark turned herself in, didn’t disclose the arrest until Thursday. “We’re not going to release any more information about (the arrest) at this time,” Maj. Gary McNeill of the Harnett County Sheriff’s Office said Thursday. Clark was taken into custody after the shooting but released a short time later.

Clark’s father-in-law, who lived next door, told the Herald in June that the couple had had marital problems and that the shooting could have been the result of a domestic dispute. Court records show Michael Clark had a lengthy list of criminal charges in his past, many of them related to domestic issues. Lee County Sheriff Tracy Carter said the Clark, who was placed on administrative leave while the case was under investigation, is no longer with his office as of Tuesday. “She did a good job for us while she was here,” Carter said. Superior Court Judge Frank Lanier set Clark’s bond at $25,000 secured.

UPDATE - Suspected Kidnapper At-Large

The Lee County Sheriff’s Office is investigating a kidnapping that occurred on Nicholson Rd. in Lee County. William Powell reported to the Lee County Sheriff’s Office that his daughter, Angelica Powell, 21, was taken from his residence on Nicholson Rd. by Lewis Marvin Fulton, 29, as she was sitting in her vehicle. While investigating the kidnapping, a detective spotted Lewis Fulton’s vehicle. After chasing Mr. Fulton into Harnett, Moore and Chatham counties, Mr. Fulton’s vehicle was disabled on Walter Bright Rd., located in Chatham County, after deputies deployed stop sticks. Mr. Fulton then jumped from the vehicle and ran into nearby woods. The victim, Angelica Powell was located, uninjured, inside the vehicle. Lewis Marvin Fulton remains at large at this time. Warrants have been obtained on Mr. Fulton for Kidnapping, assault on a female, larceny of a motor vehicle, possession of a stolen motor vehicle, speeding to elude arrest, and failure to register as a sex offender.

Wednesday, Lee County deputies and agents with the State Bureau of Investigation learned that Fulton was hiding out in a room at the Budget Inn on Hawkins Avenue. Lt. Van Holly of the Lee County Sheriff’s Office said Fulton was hit with the sex offender charge because he’d allegedly moved without alerting the sheriff’s office of the change.Fulton was the focus of controversy in Sanford in 2007 when he was being considered as a featured potter for the city’s ARToberFest celebration that October. The decision drew ire from some in the community because of his criminal record, having pleaded guilty to taking indecent liberties with a child and served prison time for the offense in the past. Fulton eventually withdrew from the festival.

Holly said Wednesday that the state Highway Patrol will charge Fulton in coming days with several traffic violations stemming from the chase. Fulton was jailed without bond

GREENSBORO — A federal jury on Tuesday awarded former Army sergeant Stephen Phelps at least $750,000 in his suit against the Moore County Sheriff’s Office and the former deputy — now the chief deputy of the Lee County Sheriff’s Office — who shot him and another soldier during a 2002 military training exercise. As the verdict was read, Phelps showed no emotion. Former deputy Randall Butler, now the second in command under Lee County Sheriff Tracy Carter, closed his eyes. Phelps said afterward: “I was happy that the truth finally came out.”The jury rendered the verdict about 9:45 p.m., after more than two hours of deliberation. Minutes before the verdict, jury members clarified with the judge the rules on awarding compensatory damages.After the verdict, lawyers sparred over whether the total damages were $750,000 or $850,000. The jury awarded $650,000 in compensatory damages and $100,000 or $200,000 in punitive damages.Phelps’ lawyer, Carlos Mahoney, had sought $1.2 million.Army 1st Lt. Tallas Tomeny died in the same incident that left Phelps severely injured. Tomeny’s estate settled out of court.Phelps and Tomeny had been taking part in Robin Sage, an exercise that trains soldiers for Special Forces.For the training, soldiers simulate infiltration of a foreign nation. Phelps and Charles Leiber, a civilian who was playing the role of an adviser, testified that they thought when Butler stopped their vehicle it was part of the exercise.Butler had argued that the men were acting suspiciously in an area that had experienced a lot burglaries. Miami Man Jailed for Rape, Robbery and $46,000.00 Worth of Cocaine In Vehicle

Quick thinking on the Sanford PD's part, their dispatch staff sent out a broadcast to be on the look out a suspect that had reportly forced a woman into her vehicle around 4 p.m. Saturday as she exited the Kangaroo store at 2219 Jefferson Davis Highway (U.S. 1), robbing and raping her.

A Lee County deputy was patrolling the area and spotted the suspect and attempted to stop him at US1 near Chris Cole Road. The suspect fled from the vehicle into a wooded area, however was apprehended quickly.

After searching the vehicle, deputies discovered approximately one half-pound ($46,000.00 worth) of Cocaine.

Sanford PD arrested Pedro (nmn) Noveron, 28, of 1519 SW 4th Street, Miami, Florida and charged him with first-degree rape, first-degree kidnapping and robbery with a dangerous weapon.

Deputies charged the suspect with Trafficking Cocaine, maintaining a vehicle to store drugs, and possession of drug paraphernalia after being found in possession of 230 grams of Cocaine. He was placed in the Lee County Jail under $400,000.00 secured bond.

Crime Alert! Avent Ferry Road Residents

10/26/09 Terry Leon Rabon of 1212 Avents Ferry Rd. Sanford, reported he came home at approximately 11:20 AM and found the rear door to his residence opened. Rabon investigated and found a white male burglarizing his home. The intruder confronted Rabon and threatened him with a firearm. Rabon retreated and called 911. The suspect was described as a white male, approximately 30 yrs old, wearing a toboggan and was driving and older model white Ford Explorer. Anyone having information on this case is urged to call the Sheriff’s Office.

Four Burglary Suspects Arrested

10/27/09 Kenneth Willard Hooker of 1611 Tempting Church Rd. Sanford reported he came home at approximately 11:30 AM and found 2 white males burglarizing his home, which then fled the scene. Hooker reported the suspects removed a diamond ring and a cell phone taken from the home. Deputies arrived soon after and were able to apprehended the suspects.

An undercover operation on 10-21-2009 by the Lee County Sheriff’s Office Narcotics Division has resulted in the arrest of one person and the seizure of ½ Kilogram of Cocaine (approx 1.1 lbs). Agents arrested Saul (no middle name) Mendiola, 29, of 54 Brookstone Drive, Cameron, in the Northview area of Lee County after being found in possession of 535 grams of Cocaine.

Mendiola was charged with trafficking Cocaine, maintaining a vehicle to keep/store drugs, and possession of drug paraphernalia. He was placed in the Lee County Jail under $500,000.00 secured bond. The estimated potential street value of the seized drugs is $107,000.00.

Raid on Thunder Lane nets 214 grams of Cocaine

On 10-20-2009, members of the Lee County Sheriff’s Office Narcotics Division conducted a search at 52 Thunder Lane, Sanford, NC. As a result of the search, agents seized 214 grams of Cocaine and items of drug paraphernalia. Agents arrested Abel Nunez Perez, 28, of 757 Raymack Drive, Lillington, and charged him with trafficking Cocaine and possession of drug paraphernalia. Perez, and illegal alien from Mexico, was placed in the Lee County Jail under $200,000.00 secured bond. A second suspect is also being sought in the case. The seized drugs have an estimated potential street value of $42,800.00.

Trick or Treat Safety Tips

Soon our streets will be scattered with little ghosts, goblins and witches trick-or-treating this Halloween. “Halloween should be filled with surprise and enjoyment, and following some common sense practices can keep events safer and more fun,” said Sheriff Carter of Lee County.

The Sheriff reminds all Lee County residents to follow these safety tips:
Motorists:
· Watch for children darting out from between parked cars.
· Watch for children walking on roadways, medians and curbs.
· Enter and exit driveways and alleys carefully.
· At twilight and later in the evening, watch for children in dark clothing.
Parents:
· Make sure that an adult or an older responsible youth will be supervising the outing for children under age 12.
· Plan and discuss the route trick-or-treaters intend to follow. Know the names of older children's companions.
· Instruct your children to travel only in familiar areas and along an established route.
· Teach your children to stop only at houses or apartment buildings that are well-lit and never to enter a stranger's home.
· Establish a return time.
· Tell your youngsters not to eat any treat until they return home.
· Review all appropriate trick-or-treat safety precautions, including pedestrian/traffic safety rules.
· Pin a slip of paper with the child's name, address and phone number inside a pocket in case the youngster gets separated from the group.
Costume Design:
Only fire-retardant materials should be used for costumes.
Costumes should be loose so warm clothes can be worn underneath.
Costumes should not be so long that they are a tripping hazard.
If children are allowed out after dark, outfits should be made with light colored materials. Strips of retro-reflective tape should be used to make children visible.

Face Design:
Masks can obstruct a child's vision. Use facial make-up instead.
When buying special Halloween makeup, check for packages containing ingredients that are labeled "Made with U.S. Approved Color Additives," "Laboratory Tested," "Meets Federal Standards for Cosmetics," or "Non-Toxic." Follow manufacturer's instruction for application.
If masks are worn, they should have nose and mouth openings and large eye holes.

Accessories:
Knives, swords and other accessories should be made from cardboard or flexible materials. Do not allow children to carry sharp objects.
Bags or sacks carried by youngsters should be light-colored or trimmed with retro-reflective tape if children are allowed out after dark.
Carrying flashlights will help children see better and be seen more clearly.

While Trick-or-Treating:
Do not enter homes or apartments without adult supervision.
Walk; do not run, from house to house. Do not cross yards and lawns where unseen objects or the uneven terrain can present tripping hazards.
Walk on sidewalks, not in the street.
Walk on the left side of the road, facing traffic if there are no sidewalks.

Treats:
Give children an early meal before going out.
Insist that treats be brought home for inspection before anything is eaten.
Wash fruit and slice into small pieces.
When in doubt, throw it out.

Homeowners/Decorations:
Keep candles and Jack O' Lanterns away from landings and doorsteps where costumes could brush against the flame.
Remove obstacles from lawns, steps and porches when expecting trick-or-treaters.

Do not leave your house unattended.

10/18/09 @ 12:45 am deputies received a call at 427 Hidden Pond to an assault in progress. Upon arrival they encountered the suspect, Kevin Scott Stone (31) W/M of 387 Hidden Pond Ln. Sanford. The deputy on scene was assaulted by Stone while attempting to take him into custody. Jessica Batts Stone of 387 Hidden Pond Ln. Sanford reported she and Stone had gotten into a domestic dispute at their home at 387 Hidden Pond Ln. Jessica Stone reported she had been assaulted and strangled by her husband Kevin Stone and had escaped and ran to 427 Hidden Pond for help. Elbert Pierce of 427 Hidden Pond Ln. allowed Jessica Stone in his home to use his phone when Kevin Stone broke in his front door. When Stone entered 427 Hidden Pond, Pierce struck Stone with a crow bar. Stone was charged with assault on a female, assault by strangulation, false imprisonment, communicating threats, simple assault, 1st degree burglary, malicious conduct by an officer, assault inflicting serious injury on a law enforcement officer, resisting law enforcement officer, forcible trespassing and injury to real property; Stone was held under no bond.

Ray Ave Resident Charged

On 10-16-2009, members of the Lee County Sheriff’s Office Narcotics Division executed a search warrant at 909 Ray Ave., Sanford, which resulted in the arrest of Christopher Lynn Elgin, 35, of the home and charged him with sell and delivery of a schedule II controlled substance (Oxycodone), maintaining a dwelling to keep and store drugs and possession of drug paraphernalia. He was released under $25,000.00 unsecured bond.

Sanford Police Seize Pot and Homemade Liquor

Kudos to the Patrol staff and Drug unit with Sanford PD this week for their work seizing nearly 2 lbs of marijuana and six gallons of homemade liquor from a house located at 2641 Fayetteville Street in Sanford. The marijuana was worth an estimated $8,460 and the liquor had an estimated worth of $1,536.

Following the raid, two residents of the home turned themselves in. Andrae Lopez Kelly, 48, and Angela Odetta Kelly, 46, both of 2641 Fayetteville St. were charged with possession with intent to sell and deliver marijuana, possession of marijuana, maintaining a dwelling for drugs, possession of drug paraphernalia, and possession of non tax paid liquor.
